Please read the Terms & Conditions carefully. In conjunction with our privacy policy, the Terms & Conditions will govern use of this website. By accessing this website you agree to be bound to the Terms & Conditions set out below. If you do not agree to be bound to said Terms & Conditions you may not use or access this website. If you do have any questions, please contact us via the contact page on this website. 

Our Terms & Conditions or Privacy Policy may change at any time by updating this page. Please check this page from time to time to review any changes to ensure you are happy. 

For the purposes of the Terms & Conditions and Privacy Policy "We/us/our" refer to JXL Performance Ltd, a company registered in England and Wales at Companies House (Company Number 15378138). Prices:

  • All prices shown include VAT, and are correct at the time of publishing, they are subject to change without prior notice.
  • Prices do not include shipping or installation fees.

VAT:

  • VAT is charged at the current rate of 20% to customers based within the UK. If you are based outside of the UK, VAT is automatically removed at checkout.
  • For purchases outside of the UK, customs and duties must be paid once the item arrives in your country, JXL Performance Ltd is not responsible for the payment of customs/duties.

Payment:

  • We accept Visa and MasterCard debit cards.
  • We also accept MasterCard credit, and Visa credit cards.
  • For card payments we require the long card number, expiry date and security code. In some instances we may require your issue date.
  • For sales in excess of £100, we can only deliver to the billing address of the card-holder, unless you are Verified by Visa, or pass 3D secure checks.
  • On some occasions we can accept bank transfers, please contact us for this.
  • Cheques are not accepted.

Your right of cancellation under Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

A consumer buyer shall have the right to cancel any contract for goods purchased by means of distance communication, in accordance to these Terms and Conditions, within 14 working days of the delivery of the goods. Custom goods shall not be refundable under this clause. Cancellation of the contract can be initiated if notified in writing by the consumer. The cancellation notice should clearly detail information such as the order number, name and address of the consumer. This is to be delivered digitally via e-mail. 

Our right to cancellation:

  • If for any reason beyond our control, including, but not limited to an inability or failure from the manufacturer to supply the goods, or for any other reason we are unable to supply the goods, we may cancel the agreement at any time, before any goods are delivered by giving notice to you via your contact details.
  • In the event that this happens, we will refund to you any sums paid including postage under or in relation to that agreement.
  • We are not liable for any losses or damages resulting from such action.

Dispatch and Delivery:

  • If you require an item quickly, please contact us by phone, or via e-mail so we can ensure the right things are put in place to make that happen.
  • At our discretion, we may drop ship your order directly from a supplier. If this happens, it will be arranged internally.
  • Whilst we will attempt to ensure all items are dispatched as quickly and efficiently as possible, delays may occur that are outside of our control, we are not responsible for any losses related to this.

Stock:

  • Our website does not display information regarding item stock. Whilst we do try and keep stock of our most popular items, it is not always possible for us to keep stock of every item. 
  • If you are having your goods installed professionally, please ensure you have received and checked your goods before committing to an appointment. We are not liable for any losses or damages related to these terms. Once an item has been professionally fitted, we accept no liability for any damages incurred.

Price Match Policy:

  • In the event that you find an item cheaper from another UK supplier, we will always attempt to, where possible, beat this price. This is ultimately at our discretion.
  • Due to international differences with pricings and taxation, we are unable to match prices presented to us from non UK based businesses. As often these prices are without VAT, and once shipping, taxation and customs are taken into account, the price often works out higher than UK pricing.
  • Before you contact us about our price match policy, please ensure the price you have received is inclusive of UK VAT. 
  • Many businesses within our area of operation advertise prices without VAT, then add the 20% UK VAT at checkout. 

Overseas Shipping Policy:

  • Overseas shipping is available at JXL Performance, please ensure you are signed in to your account to show postage to your address. 
  • Customers purchasing from ouside of the UK do not pay UK VAT (20%) this is automatically removed at checkout providing you are logged in to your account.
  • For all customers that reside outside of the UK you will very likely have to pay some form of duties/customs VAT upon your purchase, prior to the delivery of your goods
  • JXL Performance cannot estimate and/or pay for these duties/customs on your behalf, the delivery company will contact you with information on the cost, and how to pay them during the delivery process
  • Should a delivery be returned to JXL Performance due to non-payment of customs/duties cost it will be subject to the "Returns Procedure - Orders Supplied Correctly" process.
  • If you are unsure about the customs/duties VAT process, we recommend that you contact your local authorities ahead of placing your order for more information
  • In the event that you are not logged-in to your account, it is possible for UK VAT to show.
  • Due to some country specific restrictions, there are some locations that we can only accept bank transfers from.
  • All parts listed on our website are sold as tested only on Right-Hand Drive vehicles, unless stated otherwise in the product description.

Please note that import duties and taxes for orders with delivery OUTSIDE of the United Kingdom may be liable to be paid upon arrival into the destination country. This varies (sometimes a lot) from country to country. 

JXL Performance highly recommends to become aware of these potential costs BEFORE you place an order, we urge you to do your own research based on the destination country's requirements/legalities. 

If you refuse to pay the customs/duties upon arrival to your destination country, once the items are returned the customer will receive a refund for the value oof the goods paid, minus the cost of return shipping, and any customs/duties as a result of the item(s) being returned. If the returned goods do not arrive with us for any reason, JXL Performance Ltd cannot be held liable, and we reserve the right not to issue a refund for the goods in those cases. 

Returns Procedure:

  • Before returning any items to us, please ensure you have read and understood our Terms & Conditions.
  • We must be informed via e-mail of any items you wish to return for like-for-like exchange or credit, within 14 working days from the receipt of goods.
  • When returning items, please ensure a copy of the sales invoice, and information relating to your return is included with the package.
  • If a package is returned to us without the information stated above, a refund will not be given until such information is received.
  • If an item has arrived damaged, you must notify us via e-mail within 48 hours of receipt of goods. Failure to do so will constitute acceptance of the goods in the received condition and refunds may not be given.
  • Parts that have been fitted, installed or used will not be accepted for a refund. 
  • Parts which are returned in alternative packaging will not be accepted for a refund.
  • Parts returned must arrive in a resellable condition, in their original packaging. 
  • JXL Performance Ltd will not under any circumstances pay any customs/duties VAT upon returns, if we are requested to do so the return will be rejected

Refunds:

  • Refunds can, in some circumstances take up to 7 working days before they are processed. Some payment providers can take longer. If a refund has not been received in this timescale, please contact your payment provider.

For orders that have been supplied correctly:

  • Items that have been supplied correctly must be returned in a re-saleable condition.
  • Within 14 days of delivery - Goods can be returned for any reason other than outlined in these terms and conditions. Return delivery costs are payable by the consumer.
  • After 14 days of delivery - Goods can be returned at our discretion, they may be subject to a handling charge (typically 10-25% dependent on manufacturer). Return delivery costs are payable by the consumer.
  • After 28 days of delivery - Goods are unable to be returned.
  • Outbound delivery charges are non refundable.

For orders that have been supplied incorrectly:

  • Assuming the goods are in original packaging, and in a re-saleable condition, goods can be accepted within 28 days of the delivery - for a full refund, including outbound shipping, and return shipping back to us. 
  • If said goods are not in original packaging or re-saleable condition, i.e in a used condition, fitted/test fitted, or tool marked, regardless of whether the items are supplied correctly or incorrectly, they will not be accepted for a refund.

Finance/Credit:

  • Further information about the Terms & Conditions for Finance/Credit facilities will be added once we accept it as a method of payment.

Miscellaneous Terms and Conditions:

  • Parts ordered specifically/specially for a customer are unable to be returned unless the goods are of unsatisfactory quality, not fit for purpose, or not as described.
  • Any custom made orders cancelled by you as the customer maybe subject to a cancellation fee, this will be outlined in the product description where applicable. 
  • All products that require painting for fitment, must be test-fitted before finishing.
  • We reserve the right to refuse returns of exchange/surcharge units, should they be deemed as unsuitable, or unservicable.
  • We accept no claim for lost time, other garages' labour or otherwise in the event of an item return/refund.
  • No warranties are considered unless you are able to produce a legitimate sales invoice in your name.
  • All product warranties are outlined by the product manufacture. Please see their website for further details.
  • All products, are sold as off road use only, unless otherwise stated by the manufacture. 
  • No product carries any MOT, ECE or TUV approval, unless other stated by the manufacture.

Terms for the supply of Maxton Design Products

Please note the points below before ordering Maxton Design products, firstly to ensure you are up to speed with their/our terms of supply, secondly to avoid any disappointment with deliveries and/or any associated fees

  • Maxton Products that are in stock are sent 1 working day after ordering
  • Due to the huge range of products avaiable, we (JXL Performance) very rarely keep Maxton items in our own stock, please contact us prior to purchasing to check stock if you need the items quickly to avoid disappointment
  • If there is a delay on your product, we will contact you as soon as possible to make you aware of this. Please note fibreglass based products can take up to 4-6 weeks in worst case scenario circumstances 

If you are looking to return a Maxton Design product, please take note of the returns procedure below:

  • Maxton Design operate a restocking fee on all items returned, this is usually 10%, or minimum £15
  • You MUST contact us within 14 days to notify us of your return, and the item must be returned within 28 days, if you do not notify us within 14 days, we cannot accept the return

If you have ordered a Maxton Design product and need to make a change to the products ordered, or if you want to cancel them:

  • Maxton Design operate a cancellation fee for cancelled/changed orders (usually 5%) - in the circumstance that you need to amend, change or cancel an order, we will either sent you a quote for the fee (if amending the order), or deduct this from your refund (if cancelling)
